By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and RecipeRescue ("we," "us" or "our"), concerning your access to and use of the RecipeRescue website, mobile application, and any other related services (collectively, the "Service").

You agree that by accessing the Service, you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Service and must discontinue use immediately.

2. Account Registration

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You should not disclose your password to any third party.

We reserve the right to disable any user account at any time if, in our opinion, you have violated any provision of these Terms of Use.

3. Subscription and Payments

RecipeRescue may offer subscription-based services. By subscribing to any paid service, you agree to the following terms:

3.1 Payment Processing

Payments are processed through Stripe, a third-party payment processor. By submitting your payment information, you grant RecipeRescue the right to provide this information to Stripe and consent to its processing in accordance with Stripe's terms of service and privacy policy.

3.2 Recurring Billing

For subscription services, you authorize RecipeRescue to charge your chosen payment method on a recurring basis for the subscription plan you have selected. Subscription fees will be billed at the beginning of each subscription period.

3.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting our customer support. Upon cancellation, you will continue to have access to the subscription services until the end of your current billing period.

3.4 Price Changes

RecipeRescue reserves the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole discretion. Any price changes will be communicated to you before they become effective.

4. User Content

"User Content" refers to any information, text, graphics, or other material that you upload, save, or share through the Service, including your ingredient lists, saved recipes, and preferences.

4.1 License Grant

By posting User Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content solely for the purpose of providing and improving the Service.

4.2 User Content Representations

You represent and warrant that: (1) you own the User Content posted by you or otherwise have the right to grant the license set forth in these Terms; (2) your User Content does not violate the privacy rights, publicity rights, copyright rights, or other rights of any person; and (3) the posting of your User Content does not violate these Terms of Use.

4.3 Content Removal

We reserve the right to remove any User Content that violates these Terms of Use or that we find objectionable for any reason, without prior notice to you.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of RecipeRescue and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of RecipeRescue.

5.1 Recipe Content

The recipes, recipe cards, and related content generated by our AI technology are provided for your personal use only. You may print and use these recipes for personal purposes but may not distribute, publish, or commercially exploit them without our permission.

6. AI-Generated Content

RecipeRescue uses artificial intelligence to generate recipe suggestions based on user-provided ingredients. You acknowledge and agree that:

• AI-generated recipes are provided "as is" without any guarantees as to accuracy, completeness, or suitability for any particular purpose
• You should always use your judgment when preparing and consuming recipes
• We are not responsible for any adverse outcomes resulting from following AI-generated recipes
• You should always check that ingredients are appropriate for any dietary restrictions or allergies

7. Analytics and Cookies

We use Google Analytics to help analyze how users use our Service. Google Analytics uses cookies to collect information such as how often users visit the Service, what pages they visit, and what other sites they used prior to coming to our Service.

By using the Service, you consent to the processing of data about you by Google in the manner and for the purposes set out in our Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. RECIPERESCUE AND ITS AFFILIATES, SUPPLIERS, AND LICENSORS DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

RECIPERESCUE MAKES NO WARRANTY THAT: (1) THE SERVICE WILL MEET YOUR REQUIREMENTS; (2) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (3) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (4) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT RECIPERESCUE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF RECIPERESCUE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES).

9. Limitation of Liability

IN NO EVENT SHALL RECIPERESCUE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (2) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE WHATSOEVER RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE; (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICE; (5) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT RECIPERESCUE IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

10. Indemnification

You agree to defend, indemnify, and hold harmless RecipeRescue and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (1) your use and access of the Service; (2) your violation of any term of these Terms; (3) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (4) any claim that your User Content caused damage to a third party.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
